Once a patent or trademark is registered, the payment of registration fees end? – No. Maintenance annuities must be paid to keep the rights alive.
The patent right lasts for 20 years. Patent fees are low for the first few years, but as the years go by, the maintenance costs become higher and higher.
The following are the patent fees to be paid to the Japan Patent Office. (as of May 2024)
1-3rd year: annually,
¥4,300 + ¥300 per claim
4-6th year: annually,
¥10,300 + ¥800 per claim
7-9th year: annually,
¥24,800 + ¥1,900 per claim
10- year: annually,
¥59,400 + ¥4,600 per claim
Trademark Renewal Registration Fee:¥43600
The amount of maintenance costs increases as the years go by and more claims are made.
Therefore, by giving up rights or claims you do not need, you can lower the fees you pay.
You can register a waiver at any time, but the simplest way is to not pay the fee at the time of registration for renewal.
Please note, however, that waived rights cannot be restored.
Please be aware that the JPO will not be getting in touch with you regarding the annuity payment deadline.
The annuity will typically be paid by the attorney who acted as your legal representative in that nation.
However, the fee is expensive, costing about 11,000yen. We can undertake this for about half the price, so please contact us.
